USCIS Selects Final H1B Petitions by Random Selection - Almost a 50% chance for each Application

U.S. Citizenship and Immigration Services (USCIS) announced today that on April 12 it conducted the computer-generated random selection process to determine which H-1B petitions, subject to the congressionally mandated H-1B cap for fiscal year 2008 (FY 2008), would continue to final processing. USCIS completed this determination ahead of the preliminary schedule noted on April 3, when it announced it had received enough petitions to meet the cap for FY 2008.

The 123,480 cap-subject petitions received on April 2 and 3 were labeled with unique numerical identifiers and selected randomly by computer. The chosen numerical identifiers were then transmitted to the appropriate service center for further processing.

Number 123,480 looks a lot better keeping in view initial estimates. A good 50% chance for each application to be selected. 



Update: 3rd May 2007 Hello friends, I understand your anxiety. But donĂ¢€™t loose your hope and/or temper yet. Please wait till you receive either your receipt or your petition itself before concluding anything about your application. It is true that USCIS mentioned every one would receive the receipt or the petition itself in 2 weeks, but it looks like it is taking time.

Mean time, some people are even receiving the approvals. So please wait till you receive something from USCIS before planning any changes in your career paths.

Update: 11th May 2007 By today, USCIS would have sent all receipts/rejected applications to all. Give a week or two to receive the communication. So with in a week or two you will have some kind of final confirmation. Congratulations for all those who got your applications accepted and some even got approved already.

Any latest update on H1B 2008 cap.

Things are seems to very strage when I spoke to my employer, they says, they have recieved list of rejected ones and approved and still there are people yet to know the status. I don know what is it mean.??

Secondly, is there any last date to publish final list of approved / rejected candidates?

The USCIS has approved 41,000 cap-subject cases and 12,500 U.S. master degree cases as of now. They have issued about 10,000 RFEs for cap-subject cases which are pending. Approximately 4,000-5,000 RFE have been ossied for U.S. master degree cases and they are in this regard still pending. They held-up approximately 1,000 cap-subject cases for potential availability beyond those cases which had been selected, it appears that these may be rejected and returned. For the Chile-Singapore cases, they have already exhausted the special number for these cases and there are no numbers that add to the cap-subject quota from the Chile-Singapore unused numbers.
By now, they fixed no-winners in the lottery. There has been some delay in sending out rejection notices and return of checks. These rejection notices and return checks will be completely mailed by July 20, 2007.
The California Service Center has been experiencing delays in processing of receipt or approval notices for the selected cases and approved cases. Soon, the CSC will post a special email number for inquiry of these cases on the USCIS website.

i have received my employer pack from usa before last two weeks with approval note and i-129 and LCA(copy).

now in my lca its showing me the ETA case NUmber with I-xxxxx-xxxxxxx.

now i have checked the labour depart ment they said that enter case number with start with word P or D.

but mine start with I.

what does that mean..if any one can help me out.

Till today morning I was also in the same situation. The company through which I filed H1 told me that me that they were still waiting for update. But in afternoon I got a call and regarding acceptance of H1 and they gave me the receipt number. So don't loose hope and wait at least till end of June.

well !! it looks like we are in the same boat. My employer said the same. But all other people who applied with me thru the same employer, they all got the final word ... except me. infact my employer said, i still have a chance...but looks like a very remote chance. Since no other options now...let's wait.....

Hi Everyone! I have filled my H1B through consultant based in chicago. It was filled on 2nd april and I got mail from consultant station that H1B has been selected by random selection process around april 23rd. Then I have not got any updates regarding my case. The consultant is saying still no updates. My case has been filled through california service centre. He is saying that my check has been encashed. but, still no receipt no or updates. is anyone like me in same situations? if so pls let me know.

As far as my experience is concerned ur consultant is fooling u coz if ur cheques are encashed than whr is the receipt no??? its already long time since the lattery is done. and now USCIS already started the process for h1 selections.

the reason uscis gave is CIS reached sufficient number of h1b petitions to reach the numerical limitation for fy 2008 prior to recieving your petition

This is due to pent up demand for preference visa categories for which visas will become available according to the Department of State July 2007 Visa Bulletin. Premium Processing Service guarantees that within 15 calendar days of receipt of a petition, USCIS will issue either an approval notice, a notice of intent to deny, a request for evidence or open an investigation for fraud or misrepresentation.

Finally, I got my receipt no from my consultant. I have checked the status online and it shows application received and pending. It says that they got my case on 21st april. It shows processing times approximation of CSC and its says the current application they are processing for I129 is 15th april. So, any idea when I get my my approval? After long wait, my employer had mailed me, my reciept no,. which they got yesterday, it was selected in lottery on 21st april, my case is Recieved & Pending, as found on USCIS site.,
So frnds keep your hopes and beliefs high, things can happen in last moment.
But now queries are more that, pending will get approval when, by what time., but yes now i feel its like, california centre is moving with low pace, so can't judge, and estimate, so better to wait with faith and hope.

Afraid to share my analysis it may be incorrect it is purely my opinion. it looks like center is processing in alphabetical order as I have seen my friend case whose name was starting with a letter A has got his approval very early… my name starts with R ... so I have got approval after 2 months of him. STILL 4 more letter are left i.e STUV whose application may be processing ..if you have not got any RFE then dot worry have patience you will get approval after a while ...

I knew that it was going on alphabetically as it was taking too long for people with name starting with P,R,S and so on... which includes mine as well ... but whtever be the case.. I am still waiting for any update about the approval... and I would continue to... Hopefully I should get an update in a day or so.

Does anyone have a pending case at the california center? My receipt date was 20th april but still no news. The only info I have frm my employer is that they requested for additional evidence which does not reflect on the USCIS website.

I tried calling the rep at USCIS but they say that they give info only to the petitioner and not the beneficiary!!!

It is not possible that your record is not found.Either u should have received approval or u were out by lottery draw or u r petition was not kept at all.They have finished all pending works what they are telling.So,if till today ,u have notreceived anything,it is a matter to think.tk cr.

I finally got my approval. The website reflects 10 Aug as the notice date.
My receipt date was 20th Apr @ calfrn cntr. So i guess others who have the similar dates and centre would get it soon.
Also in my case USCIS had requested additional evidence and i got approval within 15 days of it.
Hope this helps people stuck with pending case.

A friend of mine had applied the employer said its rejected and they refunded
the whole money. But inspite of repeated request they never provided the receipt number.
I believe at leaset by now you should have received the receipt number.
May be you can call USCIS and check if there is any application by your name.

You are definitely selected in lottery. Probably they might require additional evidence but they will let you know. My case was also pending for a very long time and then they asked for additonal evidence and I provided and now it got approved.

Does it mean that I can get my Visa Stamped only at Kolkata Embassy?

Or Can I get it stamped in any Amrecan Embassy?

Atlast after getting RFE i got my approval with god's grace,but again another obstacle.One of my friend who applied for the same consultant got rejected because of petitioner problem,Now i have to go to the same consulate for the same consultant.Everybody are telling 90% sure that mine too will be rejected.Do anybody suggest any idea to avoid it.

Which Consulate you are talking about?

You may goto a different consulate.

I approved on 24th oct , Uscis website said approval notice sent, waiting for notice , If i want to change consulate request ,how long it takes?? please provide info.

You can goto any consulate in India.

Hi

I went for stamping on Jan 3rd.And i got VISA rejection because i showed him project description and Tax papers.But he is not satisfied with it.He needs Tax papers for more years and detailed project too..After long waiting for VISA i got rejection in chennai consulate.
So b4 going to consulate ,please make sure of your documents

my passport id expiring on 29-06-2008. can i file for h1-b for this intake.
i applied for renual but it will take all most one month so i am asking can i apply with this passport and later i will renual my passport before going to U.S consulate(if i got in lottery). can i will be possible. please replay me soon

yet not i received any receipt from my consultant, so how can i trace out that my selection is done or not? if i ask for the same to consultant than they told me wait 2weeks so is it right? help me out give some suggestions, and proper link

I spoke to my consultant and they asked me to wait till June 15th. Did anyone else too hear anything like this sort....? This uncertainty is the worst :(

my consultant said my applcation picked up. so far did not receive any number. does it takes some more time to get number. but few of my friends received the number. is there any link to check the result online by name? please provide.

should i still keep my hopeeeee ;-? but ok, atleast any probable date for the rejected applications reaching consultants ..

hi i came to know that if ur cheque is enchashed,, u can get ur receipt no. & then u can check ur H1 visa status online.

The CIS reports having completed data entry on all cases selected in the H1b lottery on May 23, 2008 and all receipts were issued by May 24, 2008. They have also stated that they have sufficient applications accepted so that a 'cushion' will not be needed this year and they have begun to mail out rejections for reserve cases (i.e. wait list) this week. The CIS currently has approximately 500 petitions they believe are duplicates and are in the process of hand reviewing these cases. Any of these cases that are determined to be actual duplicates will be rejected and those that are not will be accepted.
